Precision Litigation Northwest

Oregon Personal Injury Lawyer, Based in Bend

Hurt anywhere in Oregon?
A Bend trial firm that travels to you.

Precision Litigation Northwest is a Central Oregon firm. Our office is in Bend, and most of our clients are hurt in Deschutes, Crook and Jefferson counties. But serious-injury cases don’t respect county lines, and neither do we. We represent clients throughout Oregon, appear in circuit courts across the state, and travel to meet clients where they are.

Many of those cases come to us from other attorneys: firms with a conflict, a capacity problem, or a case that needs a trial lawyer. If you’ve been referred to us from outside Central Oregon, this page explains how it works.

How we work with clients outside Central Oregon

  • Your first consultation is by phone or video, on your schedule. It’s free.
  • You work directly with your attorney, not a case manager, from that first call onward.
  • We coordinate with your treating providers wherever you receive care.
  • We travel for depositions, mediations, hearings and trial. Distance changes our calendar, not how the case is prepared.

Oregon deadlines apply wherever you were hurt

In Oregon you generally have two years from the date of injury to file a personal injury claim (ORS 12.110). If a government body was involved, a tort claim notice may be required within 180 days. Evidence disappears well before those deadlines run, so the sooner we start, the more we can preserve.

Good to know

Where an Oregon injury case is filed, and why the courthouse matters

An Oregon injury lawsuit is filed in the circuit court of the county where the injury happened, or where the defendant lives or does business. The Oregon Judicial Department lists every courthouse. The county decides who sits on the jury, which judge manages the case and how quickly it reaches trial. Insurers know those differences and price claims by them, which is why an attorney who has appeared in a range of courts reads a case differently than one who has only settled them.

For us, venue changes travel, not preparation. The investigation, the preservation letters, the search for every policy and the demand are the same whether the case will be heard in Bend or three hundred miles away. Depositions can often be scheduled near you, and mediation is arranged where it suits the parties. When the case needs a person in the courtroom, that person is Emmanuel.

The Oregon rules that are the same in every county

Comparative fault (ORS 31.600) reduces a recovery by the injured person’s share of the blame and bars it above fifty percent, so the fault argument is the insurer’s first lever anywhere in the state. Personal injury protection on your own auto policy pays at least $15,000 of medical bills for one year regardless of fault (ORS 742.520 to 742.524), and every Oregon auto policy carries uninsured and underinsured motorist coverage that steps in when the at-fault driver has too little. The Oregon State Bar explains how uninsured driver claims work.

Beyond crashes, the same statutes apply statewide: a bar or store that serves a visibly intoxicated person can be liable for the harm that follows (ORS 471.565), a dog owner is responsible for the animal (ORS 609.140), and a driver must leave safe room when passing a bicyclist (ORS 811.065). Where you were hurt changes the courthouse; it does not change the law we use.

What happens in the first week after you call from outside Central Oregon

The first conversation is by phone or video, with Emmanuel. If we take the case, that week we send preservation letters to every party that may hold evidence, request the police or agency report, and arrange to see the scene. For a crash on a state highway, a fall in a store or a collision involving a commercial truck, the physical evidence is gone within weeks unless someone demands it be kept. That demand is the first thing we send.

Jill sends letters of representation to the insurers so the calls come to us, opens your PIP claim, and begins the records requests with the providers treating you where you live. You keep treating with your own doctors. We do not ask you to change providers, and we do not ask you to travel to Bend for anything that can be done where you are.

Wrongful death claims anywhere in Oregon

When someone is killed by another person’s carelessness, Oregon allows a claim on behalf of the family, brought through the personal representative of the estate, within three years of the injury that caused the death (ORS 30.020). These cases carry a different weight and a different set of proof: the decedent’s income, the care and companionship lost, the medical and funeral expenses. We have represented families in these claims, and we take them from anywhere in the state.

The three-year deadline is longer than the two-year limit for injury claims, but the evidence does not wait for it. Vehicles are repaired or scrapped, businesses change hands, and witnesses move. A family that calls in the first weeks gives the case the facts it will need three years later. If the responsible party is a public body, the notice deadline for a wrongful death is one year, not three.

Injured by a public body: the 180-day notice applies statewide

If a city, a county, a school district, a transit agency or a state department caused your injury, Oregon requires written notice of the claim within 180 days (ORS 30.275), long before the two-year filing deadline. That covers a crash with a public works truck, a fall on a city sidewalk, a collision with a transit bus, and a road defect on a state highway. Miss the notice and the claim can be lost, no matter how strong it is.

Public bodies are also treated differently in other ways: how the notice is delivered, who must receive it and what it must say. We handle those notices for clients across Oregon, and we treat any case with a government vehicle, building or roadway as urgent from the first call. If you are not sure whether a public body was involved, call and ask. It is the first question we check.

Why a Bend trial firm for a case somewhere else in Oregon

Because the question is not where the attorney sits but whether the attorney tries cases. An insurer values a claim by the chance it goes to a jury and what that jury might do. A firm that settles everything is priced accordingly, wherever it is located. Emmanuel has tried injury and wrongful death cases to verdict, and the demand he sends reflects a file built for that outcome.

The practical side is handled: consultations by phone or video, records gathered from your providers, depositions arranged near you, and travel for anything that needs a person in the room. What you get in exchange is a two-person firm where the attorney who takes your call is the one who stands up in your county’s courthouse. Call 541-948-8830 and tell us where it happened.

Mediation and settlement when you live far from Bend

Most contested Oregon injury cases reach a mediation before trial, and distance does not change it much. The session is held near you or by video, with a neutral carrying offers between the rooms. Emmanuel is in the room with you, in person when the case warrants it. Before the day you know the range we expect, what the liens will take from any number and what you would net. Nothing is agreed without your yes, and an unsuccessful mediation costs the case nothing but the day.

When a case does resolve, the money does not arrive as one check to you. The insurer pays the firm’s trust account. From it, the PIP carrier is repaid what it paid for your care, any health insurer or hospital lien is resolved, usually after we have asked for a reduction, the contingency fee and case costs are taken, and the balance goes to you. You receive a written accounting showing every line before anything moves.

That accounting is where the lien tracking done in the first month pays off: nothing appears at the end that was not already in the ledger. Out-of-pocket costs, mileage to appointments and unpaid time off belong in the demand, not discovered after the number is set, so keep the receipts wherever in Oregon you live, and send them to Jill as they come rather than in a pile at the end.
