What are Your Next Steps After Being Involved in a Car Accident?

What are Your Next Steps After Being Involved in a Car Accident?

If you’ve been hurt, there are several steps you need to take to protect your ability to get just and fair compensation for your damages, pain, and suffering. In Oregon, thousands of people are involved in car accidents every day. Most are fortunately minor, and the police do not get involved. However, a significant number […]

These articles cover Oregon car accident law from the side of the person who was hurt: what to do at the scene and in the first week, how fault is decided, how to deal with the insurance company, and when to settle.

A few rules run through all of them. Oregon gives you two years from the crash to file an injury lawsuit (ORS 12.110), and only 180 days to give written notice if a city, county or state vehicle or road was involved (ORS 30.275). Your own auto policy’s personal injury protection pays at least $15,000 in medical bills for one year regardless of fault (ORS 742.520 to 742.524). Oregon’s comparative fault rule (ORS 31.600) reduces what you recover by your share of the blame and bars recovery above 50 percent, which is why the insurer’s first questions are about what you did.

When the other driver has no insurance or too little, the uninsured and underinsured motorist coverage that every Oregon auto policy carries can pay the difference. If anyone was hurt, a car was towed or the damage passed the DMV’s dollar threshold, each driver must also send the DMV a collision report within 72 hours; the police report does not replace it.

The posts are written by a Bend car accident law firm for drivers, passengers, pedestrians and cyclists hurt on US-97, US-20, OR-126 and the streets of Bend, Redmond and the rest of Central Oregon. Some are seasonal, like winter ice, spring gravel and Thanksgiving travel over the passes; others deal with rideshare crashes, hit-and-runs and multi-car collisions. They are general information, not advice on your case. If you were hurt in a car accident in Oregon, call 541-948-8830 for a free consultation.
